By accessing or using TradeElevates ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our Platform.

These Terms constitute a legally binding agreement between you and TradeElevates. Your continued use of the Platform signifies your acceptance of any modifications to these Terms.

To use TradeElevates, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into a binding contract
• Not be located in a jurisdiction where cryptocurrency trading is prohibited
• Not be on any trade or economic sanctions lists, such as the UN Security Council Sanctions List
• Comply with all applicable laws and regulations in your jurisdiction

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

Know Your Customer (KYC): We may require you to complete identity verification procedures in compliance with applicable regulations. Failure to complete KYC procedures may result in account limitations or suspension.

Account Security: We strongly recommend enabling two-factor authentication (2FA) for enhanced account security. You are solely responsible for maintaining the confidentiality of your account credentials.

TradeElevates provides a platform for cryptocurrency trading with AI-powered automated trading tools. Our services include:

• AI Trading Bots: Automated trading algorithms that execute trades based on predefined strategies
• Market Analysis Tools: Real-time market data, charts, and analytics
• Portfolio Management: Tools to track and manage your cryptocurrency holdings
• Educational Resources: Materials to help you understand cryptocurrency trading

No Financial Advice: The Platform provides tools and information for educational and trading purposes only. We do not provide investment, legal, tax, or financial advice. All trading decisions are your sole responsibility.

Service Availability: While we strive for 99.9% uptime, we do not guarantee uninterrupted access to the Platform. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time.

By using our Platform, you acknowledge and accept the following risks:

• Market Volatility: Cryptocurrency markets are highly volatile and prices can fluctuate dramatically
• Loss of Capital: You may lose some or all of your invested capital
• Technology Risks: Technical failures, cyber attacks, or software bugs may impact your trading
• Regulatory Risks: Changes in regulations may affect the legality or operation of cryptocurrency trading
• Liquidity Risks: You may not be able to execute trades at your desired price or time
• AI Algorithm Risks: Automated trading algorithms may not perform as expected and past performance does not guarantee future results

You should never invest money that you cannot afford to lose. You are solely responsible for determining whether any investment, strategy, or transaction is appropriate for you based on your personal financial objectives and risk tolerance.

Use of the Platform may be subject to various fees, including but not limited to:

• Subscription Fees: Monthly or annual fees for AI trading bot plans
• Trading Fees: Commissions or fees charged on executed trades
• Withdrawal Fees: Fees for withdrawing funds from your account
• Network Fees: Blockchain transaction fees (gas fees) paid to network validators

All fees are clearly disclosed before you complete a transaction. We reserve the right to modify our fee structure with advance notice to users.

Payment Processing: All payments must be made in the currency specified. You authorize us to charge your selected payment method for all fees incurred.

Refunds: Subscription fees are generally non-refundable except as required by law or as explicitly stated in our refund policy.

You agree not to engage in any of the following prohibited activities:

• Violating any applicable laws, regulations, or third-party rights
• Using the Platform for money laundering, terrorist financing, or other illegal activities
• Manipulating market prices or engaging in fraudulent trading practices
• Attempting to gain unauthorized access to our systems or other users' accounts
• Using automated systems (other than our authorized trading bots) to access the Platform
• Interfering with the proper functioning of the Platform
• Impersonating any person or entity or misrepresenting your affiliation
• Transmitting viruses, malware, or any other malicious code
• Collecting or harvesting information about other users without consent
• Using the Platform to spam, harass, or abuse others

Violation of these prohibitions may result in immediate account suspension or termination and may be reported to relevant authorities.

All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, and AI algorithms, are the exclusive property of TradeElevates or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for your personal use only. You may not:

• Copy, modify, distribute, sell, or lease any part of our services
• Reverse engineer or attempt to extract the source code of our software
• Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
• Use our trademarks or branding without prior written permission

User Content: You retain ownership of any content you submit to the Platform. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with operating the Platform.

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for any loss of profits, revenues, data, or use
• Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim
• We shall not be liable for any losses resulting from unauthorized access to your account
• We shall not be liable for market losses, missed opportunities, or poor trading performance

Indemnification: You agree to indemnify and hold harmless TradeElevates and its affiliates from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

Your Right to Terminate: You may terminate your account at any time by contacting our support team or using the account closure feature in your dashboard.

Our Right to Terminate: We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms of Service
• Fraudulent, illegal, or harmful activities
• Extended periods of inactivity
• Non-payment of fees
• Regulatory requirements

Effect of Termination: Upon termination, your right to use the Platform will immediately cease. We will make reasonable efforts to allow you to withdraw your funds, subject to applicable regulations and our withdrawal procedures. However, we may retain certain information as required by law or for legitimate business purposes.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TradeElevates is registered, without regard to its conflict of law provisions.

Arbitration Agreement: Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform shall be resolved through binding arbitration, except that either party may seek injunctive or other equitable relief in court to protect intellectual property rights.

Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, consolidated action, or representative action.

Informal Resolution: Before initiating any formal dispute resolution, you agree to first contact our support team to attempt to resolve the issue informally.

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the updated Terms on the Platform with a new "Last Updated" date
• Sending email notifications to registered users
• Displaying prominent notices on the Platform

Your continued use of the Platform after changes to the Terms constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Platform and close your account.

Review Regularly: We encourage you to review these Terms periodically to stay informed of any updates.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and TradeElevates regarding use of the Platform.

No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

Force Majeure: We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, or network failures.
